The Site and all software, code, interfaces, content, designs, graphics, logos, trademarks, service marks, text, compilations, and other materials are owned by Short Code Voice™ or its licensors and protected by applicable intellectual property laws.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHORT CODE VOICE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
Short Code Voice DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Short Code Voice AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, OR PROCUREMENT OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS.
SHORT CODE VOICE’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100.00).
You agree to defend, indemnify, and hold harmless Short Code Voice and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
Short Code Voice™ may suspend, restrict, or terminate your access to the Site, in whole or in part, at any time and without liability, for any reason including suspected violations of these Terms, security concerns, operational needs, or legal compliance.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved exclusively by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.
YOU AND Short Code Voice™ WAIVE ANY RIGHT TO A JURY TRIAL.
YOU AND Short Code Voice™ AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE ACTION.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
Short Code Voice™ shall not be liable for delays, interruptions, or failures in performance resulting from causes beyond its reasonable control, including acts of God, internet outages, utility failures, cyberattacks, labor disputes, governmental actions, or third-party service disruptions.
Short Code Voice™ may modify these Terms or the Site at any time in its sole discretion. Updated Terms become effective upon posting. Continued use of the Site after posting constitutes acceptance of revised Terms.
These Terms constitute the entire agreement between you and Short Code Voice™ regarding Site use and supersede prior or contemporaneous understandings regarding the Site. If any provision is held unenforceable, the remaining provisions remain in full force and effect. Short Code Voice™’s failure to enforce any provision shall not constitute a waiver.
